The “Trade Agreements Act” provides authority to waive “Buy American” for equal consideration in direct Federal Procurement activities for items produced in countries with which the U.S. maintains Free Trade Agreements as outlined in the Federal Acquisition Regulation (F.A.R.)

The “Build America, Buy America Act” is the most expansive “Buy America” statute governing domestic content requirements for material sourced using Federal financial assistance (not direct Federal Procurement). Also abbreviated as BABA.
